Personal Injury/Wrongful Death

Mr. Erwin has reviewed and critiqued opposing experts, drafted cross-examinations scripts and/or participated in the analysis and modeling of economic loss and the drafting of reports in over 125 personal injury or wrongful death cases. Mr. Erwin’s expertise in personal injury loss valuation includes:

    • Issues that govern the proper framing of loss, such as the plaintiff’s duty to mitigate and the collateral source rule

    • Forecasts of future earnings

    • Fringe benefit valuation, including medical, private pension and Social Security retirement benefits

    • Retirement provisions (and benefits) for federal employees and/or military retirees

    • Household services loss

    • Offsets for a decedent’s personal consumption

    • Determination of economic loss related to future care costs, including the application of offsets for replaced "but for" consumption expenditures and/or adjustments of plan costs to actual given the injured party’s private insurance, Medicaid and/or Medicare coverage.

FELA

Mr. Erwin has reviewed and critiqued opposing experts, drafted cross-examinations scripts and/or participated in the analysis and modeling of economic loss and the drafting of expert reports in twenty-eight personal injury or wrongful death cases involving railroaders. In this area, Mr. Erwin’s expertise includes:

    • Past and present railroad-labor contracts/agreements

    • Special provisions governing railroad retirement
    • Railroad retirement benefits

    • Adjustment of present value loss for taxes as per FELA requirements

Employment/Wrongful Termination

Mr. Erwin has reviewed and critiqued opposing experts, drafted cross-examinations scripts and/or participated in the analysis and modeling of economic loss and the drafting of expert reports in three wrongful termination cases. In this area, Mr. Erwin has expertise in the valuation of complex fringe benefits packages often paid to executives, including pre-tax benefits and stock options.

MODEL/SOFTWARE DEVELOPMENT

Mr. Erwin has participated in the refinement of economic loss models developed by Spectrum Economics, Inc. For example, he developed and modeled the iteration method Spectrum uses to correctly resolve after-tax loss in FELA cases.

In addition, Mr. Erwin has developed software that allows users to estimate time-use for any group demographic based on data collected via the U.S. Department of Labor’s American Time Use Survey.
